On Thursday, the Abakaliki Division of the Federal High Court invalidated the Local Government Area (LGA) Elections held in Ebonyi on July 30.

The All Progressive Party (APC) dominated the election, which was conducted by the Ebonyi State Independent Electoral Commission (EBSIEC).

This took place in the 13 LGAs and 171 wards of the state.

However, some members of the Inter-Party Consultative Council (IPAC) boycotted the elections because of the N1 million and N200,000 nomination fees for the chairmanship and councilor seats, respectively.

The group then asked the court in case number FHC/AI/CS/151/2022 to invalidate the election results.

In a sentence, Judge Fatun Riman decided that the elections were invalid.

Mr. Riman characterized the activity as undemocratic and illegal.

The petitioner’s lawyer, Mudi Erhenedi, praised the court’s “firm judgement” in an interview with journalists after the verdict.

Mr. Erhenedi argued that it was illegal to hold LGA elections “without providing the petitioner with the exact laws intended to govern the exercise.”

He stated, “There are many other issues that do not comply with the Amended Electoral Act of 2022.

“According to the Act, the state electoral commissions must adhere to the electoral procedure when conducting elections in local government areas.

“My current position is that my clients have requested access to this law.

“We sent letters to EBSIEC, the House of Assembly, and INEC, but they refused to give us the applicable statute.

Mr. Erhenedi stated, “The law can help the candidates to determine when they are acting within or against the law during such an election.”

Roy Nweze, the defense lawyer, could not be reached to comment on the verdict.

In response to the verdict, Governor David Umahi urged law abiding residents of the state to remain calm and go about their business without incident.

Chooks Oko, his Special Assistant on Media and Strategy, issued a statement made available to journalists in Abakaliki containing his response.

“Our lawyers will analyze the sentence to determine the best course of action.

The statement continued, “My faith in the judiciary as the bastion of justice and equity remains unshaken.”
